THE BACKGROUND ISSUE

The environmental problem is being a threat to our mother nature and Most of us are not aware of the impact that might bring into our lives.

According to the report published by The New Strait Times, One of the common concerns that is related to the environment in a neighborhood is illegal dumpsites. Some irresponsible residence(s) thrown rubbish as such in residential areas which can cause smell pollution and unpleasant sight for the public. That rubbish includes clothes, plastic bags, domestic waste and such. With such action, there will be a number of effects where it can cause serious public health concern. This problem still occurs despite multiple warnings given by the City Council authorities. Thus, it is the time for us to take action and bring a real solution for those problems by implementing the ADR method.

OBJECTIVE

To identify the core problem for the environmental issues that occurs in Malaysia
To enlighten the community about the ADR in environmental issues in Malaysia
To create awareness about the function of ADR in resolving the issues of environment

JUSTIFICATION

Humans have a moral obligation to protect the environment and promote the sustainable development of the planet for future generations. Environmental degradation is detrimental and is jeopardizing the long-term health and security of animals, plants and humans. According to the department of environment, it has been reported that pollution is one of the major causes of damage to our beloved environment. There are various types of pollution which includes water pollution, air pollution, soil pollution, land pollution, ocean pollution and much more.
At the same time, so-called economic activities are destroying our environment too such as deforestation for development purposes, blastation of mountains for limestone quarrying industries, destruction of endangered animal and plant habitats for construction purposes and others. All of this is happening right in front of our eyes and sadly the public is ignoring it and turning a blind eye. This situation turns to be worse when No action is being taken in order to overcome the problem and the law enforcement is not strict which makes the wrongdoer take advantage off. It is important to note that Environment is an essential factor in human life where it shall have a huge negative impact on human life such as diseases, mutation and extinction which might affect the life cycle.
Therefore, we have chosen this topic to expose the real situation of our environment and how the existence of ADR in the legal world should be emphasized and expanded more to other matters, especially environmental issues.

EVENTS/ PROGRAMMES

As for the event, we plan to have a talk that will be conducted regarding the advantage and method of implementing ADR in resolving environmental disputes in Malaysia. It will be conducted either through a short meeting session, forum, or recorded video call session where we will be inviting an environmental activist and an environmental advocate to give the talk. We believe that they are able to provide new insights for us regarding how to tackle the problem and the importance to do so in order to save and protect our mother nature. In this given situation, the talk will be given through an online platform. It would be more convenient for us to attend the talk through this online platform where we are able to gather more public to attend it and spread the awareness. At the same time, we are planning to create a tik tok challenge where we create a short video of planting trees and cleaning up our neighbourhood to promote our initiative. Posters and videos will be circulated too in order to educate the public regarding the importance of ADR in resolving environmental matters. All of this targeted events will be shared on our social media feeds later.

TARGETED COMMUNITY

Based on the topic that we have chosen, ADR in Environmental Disputes in Malaysia, is targeted to residential areas and nearby neighborhoods who face environmental problems on a daily basis. The reason we chose this targeted community is to identify the common occurring environmental problem among the public and at the same time at the residential area. It is important for us to know what are the real problems for us to address properly and to check their knowledge on the existence of ADR in helping to resolve those issues. This survey will help them to realize that there is an easy solution for complex problems and will assist them to achieve it. ADR will help them to achieve the targeted result that they have expected for a long time but failed to achieve it.

CONCLUSION

In the nutshell, we believe that this research and survey will provide new insights and promote the usage of ADR in resolving environmental disputes in Malaysia. It is our responsibility as future lawyers to educate the public to not only depend on litigation to solve disputes but there are other methods too to solve an issue in a more convenient and faster way. Lastly, we would like to thank our coordinator for providing us this opportunity to explore more regarding this field.
